ACTA APP TERMS AND CONDITIONS OF USE

1. Identification of the Owner

These Terms and Conditions govern the access to, navigation of, and use of the ACTA mobile application, as well as, where applicable, the websites **[www.actaobra.com](http://www.actaobra.com)** (Spanish version) and **[www.acta.site](http://www.acta.site)** (English version).

2. Purpose of the App

ACTA is an application designed for the preparation, management, and generation of construction site reports, primarily intended for architects, engineers, technical professionals, site supervisors, project developers, contractors, and other professionals in the construction industry.

Through the app, users may enter information relating to construction projects, project participants, project addresses, observations, photographs, and any other content required for the preparation and export of digital reports and documents, including the generation of PDF files and other documents associated with the service.


3. Free Nature of the Service

ACTA is provided free of charge to its users.

Access to and use of the functionalities currently available within the app do not require any payment or financial consideration from the user.

Should additional features or services subject to separate terms or fees be introduced in the future, such conditions will be clearly communicated independently and shall not affect the validity of these Terms and Conditions in relation to the current free version of the app.



4. Acceptance of the Terms

Accessing, registering for, or using ACTA confers the status of user and constitutes full acceptance of these Terms and Conditions.

If the user does not agree with these Terms, they must refrain from using the app.



5. Requirements for Use

The user declares and warrants that:

* They have the legal capacity required to use the service.
* They will use the app in accordance with applicable law, good faith, public policy, and these Terms and Conditions.
* They will not use ACTA for unlawful, fraudulent, or third-party rights-infringing purposes.
* They are not using the app as a minor, as ACTA is not intended for individuals under the age of majority.


6. User Registration and Account

Access to certain features of the app requires the creation of a user account.

The user agrees to:

* Provide accurate, truthful, and up-to-date information.
* Keep their login credentials secure and confidential.
* Not share their account with third parties or allow unauthorized use of it.
* Promptly notify ACTA of any unauthorized access to or suspected misuse of their account.

7. Permitted Use and Prohibited Conduct

The following activities are expressly prohibited:

* Using the app for unlawful activities or in violation of applicable laws or regulations.
* Uploading, incorporating, or processing third-party content or personal data without the necessary legal basis, authorization, or permission.
* Reverse engineering, decompiling, extracting source code, making unauthorized reproductions, or attempting to compromise the security of the app.
* Sharing login credentials, granting unauthorized access to third parties, or using another person's account without permission.

The user also agrees not to introduce viruses, malware, malicious code, or any other element that may damage the app, its systems, or third parties.



8. User Content

The user retains ownership of and all rights to the photographs, documents, texts, reports, observations, and any other content uploaded to ACTA.

However, by uploading such content, the user authorizes ACTA and its owner to process it solely to the extent necessary to:

* Provide the requested service.
* Store and organize the information.
* Generate documents and PDF files.
* Enable synchronization and the proper functioning of the app.
* Address technical issues and provide customer support related to the service.

The user represents and warrants that the content uploaded to the app:

* Does not infringe the rights of any third party.
* Does not violate any applicable law or regulation.
* Is uploaded with sufficient legal authorization and entitlement for its processing, transfer, or incorporation into the app.

In particular, the user shall be solely responsible for any personal data, images, documents, or third-party content uploaded to ACTA and shall ensure that they have an appropriate legal basis and, where required, have provided the necessary information and obtained any required authorizations or consents.



9. Intellectual and Industrial Property

The ACTA app, including its source code, design, structure, user interfaces, databases, documentation, trade names, trademarks, logos, texts, images, compilations, and all other elements associated with the service, are owned by RAÚL PALACIOS MOLLÓN or are used under appropriate authorization, and are protected by applicable intellectual and industrial property laws.

No rights of exploitation or ownership over the app or any of its elements are granted to the user, except for a limited, revocable, non-exclusive, and non-transferable right to use the app in accordance with these Terms and Conditions.

Any unauthorized reproduction, modification, distribution, public communication, extraction, reuse, or exploitation of any element of ACTA is strictly prohibited.

10. Service Availability

ACTA is provided on an "as is" and "as available" basis.

The owner will make reasonable efforts to keep the service operational, secure, and up to date but does not guarantee uninterrupted availability or the complete absence of errors.

The service may be temporarily interrupted due to maintenance work, technical issues, software updates, force majeure events, or other circumstances beyond the owner's reasonable control.

11. Limitation of Liability

To the fullest extent permitted by applicable law, ACTA and its owner shall not be liable for:

• Errors resulting from incorrect, incomplete, or inaccurate information provided by the user.
• Technical, contractual, financial, or professional decisions made by the user or by third parties based on content generated through the app.
• Damages arising from improper use of the app, unauthorized access, or the user's breach of these Terms and Conditions.
• Incidents attributable to networks, third-party services, internet outages, app stores, platforms, external service providers, or the user's devices.

ACTA is intended as a document management and support tool and does not replace the user's professional, technical, or legal judgment.

12. Suspension or Termination of the Service

The owner may suspend, restrict, or terminate the user's access to the app, either temporarily or permanently, in the event of:

• Breach of these Terms and Conditions.
• Fraudulent, abusive, or unlawful use of the app.
• Risks affecting the security of the platform.
• Compliance with a legal or judicial requirement.

The user may request the deletion of their account at any time by sending an email to info@actaobra.com.

13. Electronic Communications

The user agrees that communications relating to the service, their account, and any technical, operational, legal, or security matters may be sent electronically.

In addition, where the user has provided consent or where there is another valid legal basis under applicable law, the user may receive commercial communications relating to ACTA and its services. In any event, the user may object to or unsubscribe from such communications at any time.

14. Amendments to the Terms

The owner reserves the right to amend these Terms and Conditions at any time in order to reflect legal, technical, functional, or service-related changes.

Where any amendment is material, users will be informed through reasonable means via the app, the website, or by email.

15. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of Spain.

Any dispute arising out of or in connection with access to or use of ACTA shall be submitted to the Courts of Castelló de la Plana (Spain), unless mandatory consumer protection legislation provides for a different jurisdiction.
